The Insolvency and Bankruptcy Code (IBC) had been implemented with a view to consolidating Insolvency & Bankruptcy Laws and addressing NPA issues affecting the economy and over the past few years, the code has helped improve the governance framework, the result of which has been the improvement in India's Ease of Doing Business ranking. Recently hon'ble Supreme Court has taken landmark decision to allow lenders initiate insolvency proceedings against personal guarantors, who are usually promoters of big business houses, along with the stressed corporate entities for whom they gave guarantee. As per the apex court there was an \"intrinsic connection\" between personal guarantors and their corporate debtors.

he Insolvency & Bankruptcy Code (Amendment) Ordinance, 2021 aims to provide an efficient alternative insolvency resolution framework for corporate persons classified as Micro, Small and Medium Enterprises (MSMEs) under the Code, for ensuring quicker, cost-effective and value maximizing outcomes for all the stakeholders for the core revival of MSMEs.
